1.Acceptance of Terms

These Terms of Use ("Terms") are a legal agreement between you and Element Forex ("we", "us", "our") and govern your use of this website and of The Profit Goldeneye 2.0 (the "Software"), including its documentation, license keys and any updates we provide.

By purchasing, downloading, installing, activating or using the Software, or by using this website, you confirm that you have read and agree to these Terms, together with our Privacy Policy, Refund Policy and Risk Disclaimer. If you do not agree, please do not buy or use the Software.

You must be at least 18 years old, and legally able to enter into a binding agreement, to purchase or use the Software.

2.License Grant

Subject to these Terms and payment of the purchase price, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the Software for your own personal trading and analysis.

• One license per purchase. Each purchase includes a single license, delivered as a personal license key.
• Personal use. The license is for you only. It may not be used on behalf of, or for the benefit of, other people or businesses unless we agree in writing.
• Tied to your key and installation. The license is linked to your license key and to the MetaTrader installation or device it is activated on, identified by the technical details described in Section 5 (such as your MetaTrader account number and a device or hardware identifier).

The Software is licensed, not sold. You receive a right to use it as set out in these Terms, and no ownership of the Software or of any copy of it.

3.Restrictions

To protect the Software and every customer who paid for it, you agree that you will not, and will not allow anyone else to:

• reverse engineer, decompile, disassemble, deobfuscate or otherwise attempt to discover the source code, algorithms or inner workings of the Software, except where the law expressly allows it despite this restriction;
• tamper with, remove, bypass or disable the license, activation or other security checks in the Software, or otherwise circumvent license validation;
• resell, redistribute, rent, lease, lend, share, publish or leak the Software files or your license key, whether free of charge or for payment;
• sublicense the Software or grant anyone else rights to it;
• copy, modify, adapt, translate or create derivative works based on the Software;
• use the Software, or what you learn from it, to build, train or improve a competing product or service; or
• use the Software in any way that is unlawful or that breaches these Terms.

Any attempt to do these things is a material breach of these Terms and may lead to termination under Section 12.

4.Intellectual Property

The Software, its design, code, indicators, panels, signals logic, documentation, graphics, text, logos and the names "The Profit Goldeneye" and "Element Forex" are owned by us or our licensors and are protected by copyright, trademark and other intellectual property laws. All rights not expressly granted to you in these Terms are reserved.

MetaTrader 4, MetaTrader 5 and MetaQuotes are trademarks of MetaQuotes Ltd. Other product and company names mentioned on this website belong to their respective owners. Their mention does not imply any affiliation with or endorsement by them.

5.License Keys, Activation and Hardware Binding

After purchase, your download link and personal license key are emailed to you. Keep your key private and secure. You are responsible for all use of the Software under your key.

To verify and protect your license, the Software checks your license key together with technical details such as your MetaTrader account number and a basic device or hardware identifier. We handle this information as described in our Privacy Policy.

A license key activates one MetaTrader installation. If you change computer, reinstall your system, change your VPS or need your activation reset for another genuine reason, please contact support and we will help. We may ask you to confirm your purchase details first, and we may decline resets that look like sharing or abuse.

6.Updates, Support and Security Maintenance

We may release updates to the Software from time to time, for example to fix issues, improve features, adapt to changes in MetaTrader or protect the license system. We may also provide email support to help you install, activate and use the Software.

How long updates and support are included in your purchase is set out in Section 17, Pricing, Updates and Support Period, which forms part of these Terms. In short: your purchase includes updates and support for one (1) year from the date of purchase.

We aim to keep the Software working well, but we do not promise that any update will be released, that any particular feature will be added or kept, or that the Software will always be available, uninterrupted or error-free.

7.Trading Risk Disclosure

The Software is an analysis tool. It is not financial, investment, legal or tax advice, and nothing about the Software or this website is a recommendation to buy or sell any instrument.

• Trading foreign exchange, gold and other leveraged products carries a high level of risk, and you could lose some or all of your capital.
• We do not guarantee profits or any particular result. Past, historical or back-tested performance, and any screenshots or illustrations, are not indicative of future results.
• All trading decisions are yours alone, and you are solely responsible for them and for any resulting gains or losses. Consider practicing on a demo account first and seek independent professional advice if you are unsure.

8.Refunds

Refunds are governed by our Refund Policy, which is incorporated into these Terms by reference. Please read it before you buy.

9.Third-Party Platforms and Data

The Software runs on third-party platforms and depends on services we do not own or control, including MetaTrader 4 and 5, your broker, your internet connection, your computer or VPS and your operating system. We are not responsible for:

• the availability, performance, pricing, data feeds, execution, spreads or policies of any broker or trading platform;
• delays, outages, errors or gaps in market data or in your connection;
• changes made by MetaQuotes, your broker or your operating-system vendor that affect how the Software behaves; or
• any loss caused by the hardware, VPS, network or other services you choose to use.

Your use of third-party services is subject to their own terms and policies.

10.Disclaimer of Warranties

To the fullest extent permitted by law, the Software and this website are provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement or uninterrupted or error-free operation.

Nothing in these Terms excludes any rights you have under consumer protection laws that cannot lawfully be excluded.

11.Limitation of Liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, trading capital, data or business opportunity, arising out of or related to your use of, or inability to use, the Software or this website, even if we have been told such loss is possible.

To the fullest extent permitted by law, our total liability for any claim relating to the Software or these Terms is limited to the amount you paid for the Software.

Nothing in these Terms limits liability that cannot be limited under applicable law.

12.Termination

These Terms apply until terminated. We may suspend or revoke your license and access to the Software, with or without notice, if we reasonably believe you have breached these Terms, including by sharing, reselling or leaking the Software or your license key, circumventing license checks, or abusing payment or refund processes.

If your license is revoked because of a breach, you must stop using the Software and delete all copies, and no refund will be due. You may stop using the Software at any time. Sections that by their nature should continue after termination (including Sections 3, 4, 7, 10, 11 and 15) will continue to apply.

13.Privacy

How we collect, use and protect your information is described in our Privacy Policy.

14.Changes to These Terms

We may update these Terms from time to time, for example to reflect changes to the Software, our services or the law. The "Last updated" date at the top of this page shows when they last changed. Changes apply from the date they are posted and do not reduce the update and support period you already purchased. By continuing to use the Software or this website after an update, you accept the revised Terms.

15.Governing Law

These Terms, and any dispute arising out of or relating to them or to the Software, are governed by the laws applicable at the seller's place of business, without regard to conflict-of-law rules. Subject to any mandatory consumer rights you may have where you live, the courts with jurisdiction over the seller's place of business will have jurisdiction over any such dispute.

If any part of these Terms is found to be unenforceable, the rest will remain in effect. These Terms, together with the policies they refer to, are the entire agreement between you and us about the Software.

17.Pricing, Updates and Support Period

The one-time purchase price includes all support and software updates for one (1) year from the date of purchase.

• During the first 12 months: you receive all software updates, security updates and email support for the version you purchased.
• After the first 12 months: the version you purchased continues to work as is, but we provide no further updates, security patches or support for it. We cannot guarantee that it will stay compatible with future changes to MetaTrader, brokers or operating systems.
• To keep receiving support, updates and the latest security updates after the first year, a further payment is required, by renewal or by purchasing the then-current version.
• No lifetime updates or upgrades are promised. Nothing on this website or in any communication should be read as a promise of lifetime updates, free upgrades or free support beyond the first year.

17.1 Version 1.0

The original The Profit Goldeneye (version 1.0) reached end of life on October 16, 2026. It is not covered by the update and support period described in this section and will receive no further updates, security patches or support.

17.2 How the 12 months are counted

The period starts on the date of your original purchase and ends twelve (12) months later. It does not restart on its own and is not extended by downloading, installing or activating the Software later.

This section is an essential term of the sale. It applies to the one-time price displayed on this website and takes priority over any more general wording elsewhere on this website about updates or support.
